Terms & Conditions

1. Scope

These Terms and Conditions apply to tickets sold via xo-festival.de for XO Festival events. They apply to consumers and other purchasers for all orders placed through the event pages and the associated checkout.

3. Formation of the contract

The presentation of events and tickets is not a binding offer. By submitting an order, the customer makes a binding offer to purchase the selected tickets. The contract is formed when the payment is successfully completed and the order is confirmed. The customer must check the order details before submitting the order.

4. Prices and payment

All prices shown in the checkout are total prices. Payment is made through the payment methods offered in the checkout, in particular PayPal and Revolut Pay. The full ticket price is due when the order is completed. A ticket is not valid until payment has been successfully confirmed.

5. Ticket delivery

Tickets are issued electronically after successful payment and are sent to the email address provided or made available in the XO Account. The customer is responsible for providing a correct email address and keeping the ticket and its QR code safe from unauthorised access. Each ticket may be used only once.

6. Right of withdrawal

Under section 312g(2)(9) of the German Civil Code, there is no statutory right of withdrawal for contracts relating to leisure activities where the contract provides for a specific date or period of performance.

7. Cancellation and returns

Tickets that have already been purchased cannot be cancelled or returned, unless mandatory law or an express agreement provides otherwise. Tickets that are not used do not give rise to a refund.

8. Cancellation, postponement and programme changes

If an event is cancelled, the ticket price will be refunded using an appropriate payment route. If an event is postponed or its programme changes substantially, we may additionally offer rebooking to another event or date. Changes to individual artists, programme items, running order or event areas do not automatically entitle the customer to a refund where the overall character of the event is preserved.

9. Age restriction and admission

Admission is restricted to persons aged 18 or over. The age shown on a valid official photo ID presented at the entrance is decisive. A valid ticket does not replace the required proof of age. Admission may be refused where the requirements are not met.

10. Resale

Tickets may be resold privately, but not commercially. In particular, resale at an excessive price, systematic resale, auctioning for profit and resale in connection with advertising or competitions without prior consent are prohibited.

11. Photography and video recordings

Photographs and video recordings may be made at events for reporting, documentation and marketing purposes. Where legally required, the relevant legal basis and the rights of the persons concerned are respected. Visitors may contact us if they have a specific concern about a recording.

12. House rules and conduct

The organiser and authorised venue staff exercise the right to determine admission and conduct on the premises. Visitors must follow reasonable safety and organisational instructions. Persons who endanger others, seriously disrupt the event, carry prohibited items or breach applicable rules may be refused admission or removed without reimbursement, subject to mandatory law.

13. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory statutory liability applies. For slight negligence, liability is limited to breaches of essential contractual duties and to foreseeable damage typical of the contract. Liability for items brought to the event is excluded except where mandatory law provides otherwise.

14. Android and iOS mobile app

The XO Festival app supplements the website and may provide tickets, event information, account functions, push notifications, points, status and check-in functions. Availability may depend on the device, operating system, app-store services and network connection. Individual functions may be changed or discontinued for the future where reasonable.

15. XO Status

Verified XO Accounts start as XO Members and may earn points and higher status tiers through qualifying ticket purchases, event visits, friend invitations and selected community activities. Points do not normally expire, but are not transferable, purchasable, redeemable for cash or of monetary value. Points may be reversed in the event of refunds, errors or misuse. Status thresholds, point values and communicated soft benefits may be changed for the future.

16. Privacy and Meta app

Personal data is processed for ticket sales, payment, event organisation, the Android and iOS apps, and the technical Meta app connection for Instagram and Facebook channels. Further details are available in our Privacy Policy. Requests for permanent deletion can be submitted via Delete your data.

17. Consumer dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

18. Final provisions

The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected. If any provision is or becomes invalid in whole or in part, the remaining provisions remain effective.
